1. Acceptance of Terms

By accessing or using the website located at cupertinofence.com (the "Site"), or by requesting, scheduling, or receiving services from Premier Cupertino Fence ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or our services.

These Terms apply to all visitors, users, and customers of the Site and to all fencing installation, repair, and related services we provide.

2. Description of Services

Premier Cupertino Fence provides residential and commercial fencing services in Cupertino, CA and surrounding cities, including but not limited to:

• Fence installation (wood, vinyl, chain link, aluminum, ornamental iron, and other materials)
• Fence repair and maintenance
• Fence replacement
• Gate and automatic gate installation
• Custom fence design
• Fence staining and sealing
• Pool, pet, and security fencing
• Commercial and farm fencing

We reserve the right to decline any project at our sole discretion.

3. Estimates and Pricing

Free on-site estimates are provided as a courtesy. All estimates are based on information available at the time of the site visit, including visible conditions, customer-provided measurements, and standard material costs as of the estimate date.

Estimates are not binding quotes unless presented in a signed written agreement or contract. Final pricing may change if site conditions differ materially from those observed at the time of the estimate, if the scope of work changes at the customer's request, or if unforeseen conditions (such as buried obstructions, utilities not previously marked, or non-standard soil conditions) are encountered during installation.

We will communicate any material price changes in writing before proceeding with work that would cause a cost increase. The customer has the right to approve or decline any change in scope or price before additional work is performed.

4. Scheduling and Cancellation

Project start dates are scheduled by mutual agreement and are subject to availability, permit processing timelines, weather conditions, and material lead times. We will provide a reasonable estimated start window and notify you if scheduling changes are necessary.

Cancellations made after materials have been ordered or work has commenced may be subject to restocking fees, labor costs already incurred, or other direct costs. The specific terms will be outlined in your project agreement or contract.

5. Payment Terms

Payment terms are specified in the written project agreement or contract provided before work begins. In general:

• A deposit may be required before work begins or materials are ordered. The deposit amount will be stated in your project agreement.
• Final payment is due upon project completion and customer walkthrough, unless otherwise specified in writing.
• Accepted payment methods will be specified in your project agreement.
• Invoices not paid by the due date may be subject to a late payment fee as specified in the project agreement.

Title to and ownership of materials installed on your property transfers to you upon receipt of full payment. Until full payment is received, Premier Cupertino Fence retains the right to remove materials that have not been paid for, subject to applicable law.

6. Customer Responsibilities

By requesting our services, you represent and agree to the following:

• You have the legal authority to authorize fence installation or modification at the project address.
• You have provided accurate information regarding property lines, HOA rules, and any known underground utilities or obstructions.
• You are responsible for obtaining any required HOA approval before work begins. We may assist with documentation upon request, but responsibility for HOA compliance rests with the property owner.
• You will clear the fence line of plants, decorations, irrigation lines, and personal property before the scheduled installation date, unless other arrangements have been made in writing.
• You will keep children and pets away from the work area during active installation.

7. Permits and Regulatory Compliance

Where a building permit is required by the local jurisdiction, we will advise you of the requirement. If we agree to pull the permit on your behalf, the permit fee will be included in or added to your project invoice. You remain responsible for ensuring that the project complies with all applicable local ordinances, HOA rules, and other regulations. We are not liable for delays, fines, or removal costs arising from HOA violations or permit non-compliance where you failed to provide accurate information about your property restrictions.

8. Workmanship Warranty and Disclaimers

We stand behind our workmanship. The specific terms of any workmanship warranty will be stated in your project agreement. In general, we warrant that our installation work will be free from material defects caused by our workmanship for the period specified in your agreement.

This warranty does not cover:

• Damage caused by third parties, accidents, vandalism, or acts of nature (including but not limited to storms, floods, fires, or seismic events).
• Normal wear and tear, weathering, or fading consistent with the expected lifespan of the materials used.
• Damage resulting from failure to perform routine maintenance as recommended.
• Pre-existing conditions at the property that were not disclosed to us prior to the project start.

Materials carry only the manufacturer warranty provided by the manufacturer. We make no additional warranty regarding materials beyond what the manufacturer provides.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Premier Cupertino Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Site, your reliance on information provided on the Site, or the performance of services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to us for the specific project giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

If a dispute cannot be resolved through direct communication, both parties agree to attempt resolution through mediation before pursuing any other legal remedy. Any legal action arising from or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and both parties consent to the personal jurisdiction of those courts.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

12. Intellectual Property

All content on the Site - including text, photographs, graphics, logos, and design elements - is the property of Premier Cupertino Fence or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.

13. Acceptable Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Use the Site in any way that violates applicable federal, state, or local law.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Submit false or misleading information through any form or contact method on the Site.
• Use any automated means to scrape, crawl, or collect data from the Site without our prior written consent.
